DEMOSCIOCRACY in the WORK sector — English

Translation of the French article by Jacques Rouchaud

PRIVATE SECTOR — FREEDOM, EQUALITY, TRUTH

To be distinguished from the Constitution of Demosciocracy

The Constitution of Demosciocracy defines the political and institutional organisation of society: representation of the People, representation of the Corporations, Territories, two Chambers, the executive and oversight of the institutions.

The rules concerning private companies, employees, executives, entrepreneurs and investors must be dealt with separately.

They constitute an Economic and Social Code of the private sector, which may be adapted when changes in work, the economy or technology require it.

Freedom of private enterprise

Private enterprise remains free.

Entrepreneurs and investors must be able to create, develop, finance, pass on and run their companies.

It is not the State’s role to administer private companies on a day-to-day basis.

But economic freedom cannot permit the abusive exploitation of one person or group by another.

The law must therefore simultaneously protect:

  • employees against exploitation;
  • entrepreneurs against unjustified constraints;
  • investors against the confiscation or abusive use of their capital;
  • and the company itself against abuses of power, whatever their origin.

Protection of employees

No human being must be able to be treated as a mere economic resource.

The law guarantees in particular decent working conditions, pay corresponding to qualifications and responsibilities, safety at work, rest, training and professional equality.

For equivalent qualifications, function, responsibility and work, women and men must benefit from the same pay rules.

Economic organisation of the company

The principle proposed for private companies is that of 30–30–30–10, on an economic basis that will have to be precisely defined:

  • 30% for all remuneration, from General Management down to all employees, according to functions, qualifications and responsibilities;
  • 30% for investment, modernisation, research, training and development;
  • 30% for shareholders and investors, as remuneration for the capital committed and the risk taken;
  • 10% for financial reserves, in order to protect the continuity of the company and jobs.

Company Council

The Company Council belongs to the organisation of the private sector and must not be confused with the constitutional institutions of Demosciocracy.

Every person working in the company may take part in the Company Councils provided for by law or be represented by a colleague of their choice whom they trust.

Its functioning is inspired by the principles of direct representation used in the Territories, while being adapted to the particular realities of the company.

Adaptable laws

The Constitution sets out the fundamental principles and must not be modified according to economic circumstances.

On the other hand, the laws governing the private sector must be able to evolve.

The two Chambers can thus adapt legislation when new forms of exploitation, economic concentration, domination or imbalance appear.

The competent State bodies monitor the application of these laws within the framework of the missions entrusted to them.

The objective is to maintain a permanent balance:

  • protect the one who works;
  • protect the one who undertakes;
  • protect the one who invests;
  • prevent any individual or group from abusively exploiting others.

Economic freedom exists, but it must never become the freedom to enslave.

FREEDOM — EQUALITY — TRUTH
